1. License Grant
Smashd grants you a personal, non-exclusive, non-transferable, revocable licence to install and use the Smashd application (the "App") on devices you own or control, solely for your personal, non-commercial use, subject to this End User License Agreement ("EULA").
2. Restrictions
You may not:
- Copy, modify, or distribute the App or any portion of it.
- Reverse-engineer, decompile, or disassemble the App.
- Rent, lease, lend, or sublicense the App to any third party.
- Use the App for any unlawful purpose.
- Remove or alter any proprietary notices or labels on the App.
3. User-Generated Content — Zero Tolerance Policy
The App allows users to create profiles, join groups, and interact with other players ("User Content"). Smashd operates a zero-tolerance policy for objectionable content and abusive behaviour.
The following are strictly prohibited and will result in immediate account termination:
- Hate speech, discrimination, or content targeting individuals based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
- Harassment, bullying, threats, or intimidation of other users.
- Sexually explicit, violent, or otherwise offensive content in usernames, avatars, or group names.
- Cheating, boosting, or any form of match manipulation.
- Impersonation of other users or Smashd staff.
Smashd reserves the right to remove any User Content that violates this policy at any time without notice.
4. Reporting & Blocking
You can report objectionable content or abusive behaviour directly in the App by visiting a user's profile and selecting "Report" or "Block". Reports are reviewed by our moderation team within 24 hours. Smashd will take action — including content removal and account suspension — where a report is upheld.
Blocking a user prevents them from seeing your profile and appearing in your match history. Blocked users are not notified.
5. Updates
Smashd may release updates to the App from time to time. This EULA applies to all updates unless a separate licence accompanies the update, in which case the terms of that licence govern the update.
6. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies in your possession.
7. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranty of any kind, express or implied. Smashd does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Smashd shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of or inability to use the App.
9. Apple App Store — Additional Terms
This EULA is an agreement between you and Smashd only, not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content. Apple has no obligation to provide any maintenance or support for the App. In the event of any failure to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); Apple has no other warranty obligation whatsoever with respect to the App.
Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, consumer protection claims, or intellectual property infringement claims. Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance of its terms, Apple will have the right to enforce this EULA against you as a third-party beneficiary.
